Your privacy is important to us. It is M&C ACTION ECLUBS LIMITED's policy to respect your privacy regarding any information we may collect from you across our website, http://eclubs.gr, or our app eClubs.

TERMS OF CONDITIONS OF USE

The Company “M&C ECLUBS LIMITED” has created and operates the online service legally "ECLUBS" (hereinafter referred to as the "Service") operating through electronic application "ECLUBS" on your mobile phone or any other electronic device platform (hereinafter referred to as "the Application") for the purpose of its use by users for making reservations to partners companies they operate one or more entertainment centers of any form (e.g. Night Clubs, Bars, Café Bars), hereafter called "Partners". In particular, the "Application" customer enters this and chooses among the Affiliates participating in the "Application" to make online bookings on a specific day and time and for a certain number of tables or tickets (individual) at a price that freely determines and is collected by the Partner. The price will be paid in full by the customer, either by using a credit card, or by electronic payment through the PayPal application, or directly to the partner's business with cash or credit card use.
Please make sure you understand the terms and conditions of the application and agree with them before proceeding with the use of the application, as the use implies the explicit and unconditional acceptance of the terms and conditions set forth herein as below.
The Company has taken all necessary steps to safeguard the security and confidentiality of information regarding the Application Service Users and is very confident about protecting your privacy.
The registration and use of the Application imply the unconditional acceptance, consent, approval and agreement of the User with the terms and conditions of use of the application and the policy we follow.

PROCEDURE AND REFUND

The User recognizes that the Company acts as an intermediary (agent / agent) and does not provide the services exclusively undertaken by the Partners. Furthermore, it does not enter and does not participate in any way in fulfilling the services of the Partner with the customer.
Each reservation is valid for a specific date and time of arrival and for a certain number of people who visit the Partner in order.
After making a reservation, the User has the right to cancel. The cancellation of the online reservation can be made by the client-user either through the "Application" and automatic updating of the software managed by the Partner, or by telephone communication directly with the Partner, in which case the latter undertakes to immediately update the "Application "Through the "Management Platform ".
In the case of a table reservation, it provides without queued access directly to it through its competent staff and if an electronic prepayment has been made, it scans the "Entry Scanner" the QR code to be displayed by the user, up to completion of the maximum number of corresponding positions.
The Partner reserves the right to refuse to provide the services and products associated with the online reservation in the event of the customer being not present, (a) with a delay of more than half an hour (30 minutes) from the scheduled time of arrival for electronic bookings paid by cash in the business and b) delayed beyond the scheduled time of arrival for electronic bookings prepaid via electronic payment.
In the event that the reservation holder does not arrive at any time (non-show) and does not cancel (timely or not) the online reservation, the Partner has the right to refuse to provide the services with the electronic booking and any amount prepaid by the customer by electronic payment is forfeited in favor of the Partner as a pre-agreed, reasonable and liquidated penalty against the holder of the reservation.
In the event that the customer makes a total or partial cancellation of the prepaid electronically up to 10 days prior to the scheduled day of attendance in the Partner's business, the Partner is bound by the present to directly reimburse this amount corresponding to 85% of the prepaid price. The above obligation to reimburse the above amount on behalf of the Partner does not in any case constitute recognition of a liability of the Company to the user-client.
In the event that the customer cancels the prepaid reservation in whole or in part but within a shorter / shorter interval of 10 days from the scheduled appointment day, the Partner is bound by the present as within two (2) months from the day of the canceled reservation and in direct contact with the Company via e-mail, accepts an order for reservation of the user-choice alternative day and time, providing services and products of equivalent value prepaid price.
Upon the expiration of the two (2) months, the Partner may refuse to provide the services related to the online booking, and the amount pre-paid by the customer through an electronic payment is forfeited in favor of the Affiliate, as pre-agreed, reasonable and cleared penalty against the user-client.

PRIVACY POLICY

Choice and consent: By providing personal information to us, you consent to us collecting, holding, using and disclosing your personal information in accordance with this privacy policy. If you are under 18 years of age, you must have, and warrant to the extent permitted by law to us, that you have your parent or legal guardian’s permission to access and use the application and they (your parents or guardian) have consented to you providing us with your personal information. In event of booking via the application, it is therefore presumed that the User is over 18 years of age of age or if under 18 years of age, has obtained the necessary consent from the person parental responsibility which the user will be provide the details if requested. Parents of minor must protect minors from accessing alcoholic beverages and are responsible for the consequences otherwise not followed.
Furthermore, the User expressly consents to the necessary collection and processing of personal data for the purposes of this Agreement alone and during the use of the "Application".

COPYRIGHT

The Company owns all copyright as the intellectual creator of the application and service, is the legal owner and administrator of the "Application". The "Service" is exclusively electronically supplied and the place of supply is the registered office of the Company.

USER LIABILITY

The user of eClubs agrees to use the application in accordance with the provisions of applicable Greek and European Law that it will not use any language that violate morality, defamatory, annoying or obscene or exposing specific persons or groups of persons on the basis of religion, nationality, sex, sexual orientation, etc.
If any use is made of the aforementioned, the Company reserves the right to monitor and filter them by rejecting, deleting or editing comments. The Company also has the right to automatically delete the User without notice, by proceeding to any actions provided for by the applicable law and the relevant provisions. Each user is also responsible for maintaining the privacy of his account in order not to be used by third parties.

PERSONAL DATA AND PROTECTION POLICY

The User is solely responsible for maintaining the privacy of the password that he has chosen when registering in the "Application".
The Company maintain a file with the e-mail address of the application users related to the application services (account creation, confirmation and cancellation of reservations.)
The Company can send push notifications, including new events and special offers from the Partners. In the case of push messages, the User can choose whether to receive them during the registration process, within the management of his profile in the application.
OTHER CONDITIONS
Throughout this Agreement, the User agrees to comply with the applicable laws and the Company's Business Conduct Standards and Company Policies (Privacy Policy, Cookies) in connection with the operation and use of the "Application".

DISCLAIMER

EClubs is not responsible for the quality, properties, individual characteristics of the services, benefits and products of the Partners in the application.
The Company does not guarantee that the services, contents of the application will be provided without interruption, without errors and that the errors will be corrected.

POLICY CHANGE

It is possible to change the policy or service without notice to improve the Company’s services. It is therefore recommended that Users read the terms of use at regularly in order to be informed of any changes in their content. By agreeing, the User will be bound by the current version of these terms of service.

APPLICABLE LAW

The above terms of use, as well as modifications, alteration thereof, are governed by and supplementary Greek Law, European Union Law and relevant international treaties. This is the overall agreement between clubs and users and it only binds them. The Company reserves the right to unilaterally modify or renew these terms in accordance with its needs and customary practices. present terms and conditions shall be subject to the exclusive jurisdiction of the Courts of Athens, in agreement with the parties and within the jurisdiction of the Greek Courts.
